SKYCADDIE LOYALTY REWARDS AND UPGRADE PROGRAM TERMS AND CONDITIONS 

These terms and conditions (these “Terms”) apply to the SkyCaddie Loyalty Rewards and Upgrade Program promotion. 

Subject to these Terms, the SkyCaddie Loyalty Rewards and Upgrade Program provides two benefits—Lifetime Access Benefit (“Lifetime Access”) and Upgrade Credit Benefit (“Upgrade Credit”). 

Lifetime Access Benefit:  Lifetime Access allows you to continue to use your eligible SkyCaddie device for the Useful Life (as defined herein) of your eligible SkyCaddie device and extends for the Useful Life of your eligible SkyCaddie device the license granted to you by your SkyCaddie membership subscription in effect at the time of your SkyCaddie Loyalty Rewards and Upgrade Program purchase, subject to the modifications and amendments set forth in these Terms.  Lifetime Access is subject to the following, which you agree shall be a modification and amendment of your existing SkyCaddie membership subscription: 

1. The term of your SkyCaddie membership subscription, as amended by these Terms, is extended for the Useful Life of your eligible SkyCaddie device, as “Useful Life” is defined in these Terms. 

2. Lifetime Access is a “cut the cord” program, so after your SkyCaddie Loyalty Rewards and Upgrade Program purchase your eligible SkyCaddie device will not have access to SkyGolf’s systems or services; you will not be able to sync your eligible SkyCaddie device; you will not receive golf course map updates or changes for your eligible SkyCaddie device; you will not receive operating system, firmware, or other software updates for your eligible SkyCaddie device; and you will not be able to upload your scores or access any SkyGolf 360 service or feature.  The golf course maps for your eligible SkyCaddie device, and your eligible SkyCaddie device operating system, firmware, and other software, will be limited to that which is loaded on your eligible SkyCaddie device at the time of your Legacy Reward Promotion purchase.  

3. The Lifetime Access, and the underlying membership subscription, is non-transferable to a third-party or subsequent device owner and may not be transferred to another SkyCaddie device, including if your eligible SkyCaddie device becomes inoperable.  If you purchase another SkyCaddie device, including through the Upgrade Credit, such other SkyCaddie device will require a new annual SkyGolf membership subscription.      

Upgrade Credit Benefit:  If you decide to upgrade your eligible SkyCaddie device within 24 months of your SkyCaddie Loyalty Rewards and Upgrade Program purchase, SkyGolf will provide to you a one-time promotional upgrade credit equal to your $99 SkyCaddie Loyalty Rewards and Upgrade Program purchase price toward the purchase of an eligible new SuperTag-ready SkyCaddie device which is purchased directly from SkyGolf. 

The Upgrade Credit is a promotional loyalty benefit equal to the SkyCaddie Loyalty Rewards and Upgrade Program purchase price.  Upgrade Credit has no cash value, is non-transferable, may not be redeemed for cash, may not be applied to non-eligible products or services, may not be combined with other promotional offers, and is subject to eligible product availability at time of redemption.  SkyGolf reserves the right to, from time to time, designate eligible upgrade products for redemption and to substitute comparable eligible products.  Upgrade Credit is only valid for 24 months from your SkyCaddie Loyalty Rewards and Upgrade Program purchase. 

SkyCaddie Loyalty Rewards and Upgrade Program Purchase Non-Refundable:  Your SkyCaddie Loyalty Rewards and Upgrade Program purchase is non-refundable.
